Terms of Service & Escrow Framework
Last updated: October 2026. Governing access and transactions conducted on trade.domains.
1. Marketplace Operations & 3% Fee
trade.domains operates a decentralized and registrar-integrated exchange for domain names. The platform levies a flat 3% transaction fee on the final agreed settlement amount upon successful escrow closure.
2. Ownership Verification & Listings
Every listed asset must undergo DNS TXT record authentication or registrar API handshake. Users are strictly prohibited from listing domains they do not legally control. Stolen domains or fraudulent attempts will result in immediate blacklisting and forfeiture of pending balances.
3. Peer-to-Peer Domain Swaps (Barter)
When parties agree to a domain-for-domain swap (with or without cash adjustments), both domain assets are placed under automated transfer hold. Neither cash balance nor domain auth codes are released until both registrars confirm recipient transfer.
4. Inspection Period & Settlement
Buyers receive an automated 48-hour inspection period following auth-code delivery to confirm DNS control. Upon expiration or buyer confirmation, escrow funds are automatically disbursed to the seller via wire, ACH, or USDC.
5. ICANN & Trademark Compliance
trade.domains complies with ICANN Uniform Domain-Name Dispute-Resolution Policy (UDRP). Any listings infringing upon active, registered trademarks will be removed upon verified intellectual property notice.
6. Third-Party Trademarks & Nominative Fair Use
All product names, logos, trademarks, and registered trademarks (including but not limited to Cloudflare, Dynadot, Namecheap, Porkbun, GoDaddy, Sedo, and Flippa) mentioned on this website are the property of their respective owners. Any reference to these entities is purely for identification, technical compatibility, interoperability, and comparative purposes, and does not constitute or imply any official affiliation, endorsement, or sponsorship by those entities.
7. Escrow Facilitation & Third-Party Custody
trade.domains is an independent domain marketplace and transaction facilitator. All financial custody, holding of escrow funds, and payment disbursements are conducted exclusively through licensed, regulated, and bonded third-party escrow partners (such as Escrow.com or licensed financial institutions). trade.domains does not directly hold, bank, or custody customer funds.
8. Pricing Errors, System Glitches & Invitation to Treat
All prices, valuations, bids, and listings presented on trade.domains constitute an invitation to treat (invitation to negotiate) and do not represent a self-executing unilateral contract of sale. In the event of a typographical error, software bug, display glitch, or system malfunction displaying an erroneous price (including any price materially divergent from fair market value), trade.domains and the asset registrant reserve the absolute right to cancel, refuse, or void any initiated transaction or inquiry. No legally binding contract of sale is established until both buyer and seller execute mutual written closing instructions within an accredited third-party escrow provider.
9. Manual Registrar Transfer & No Automated Registry Execution
trade.domains maintains no programmatic, direct, or automated write access to domain registry databases or registrar EPP interfaces. The transfer of any domain name legally requires the registered owner to manually remove registrar lock status, generate an EPP Authorization Code directly within their accredited registrar account, and deliver it via secure escrow instructions. No domain can be transferred, reassigned, or acquired automatically or accidentally through this interface.
